Pemi LLC ("Pemi," "we," "us," or "our") respects your privacy and your right to control your personal information. This page explains your rights under the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and similar privacy laws in other U.S. states, and how to exercise them.
What "Sale" and "Sharing" Mean
Under California law, the terms "sale" and "sharing" are defined broadly. They do not just mean exchanging your data for money. They can also include:
- Sharing your information with advertising partners (such as Meta, Google, TikTok, or Pinterest) for cross-context behavioral advertising
- Allowing third parties to use cookies, pixels, or similar tracking technologies on our website to build profiles about you
- Transferring personal information to analytics providers that combine your data with information from other sources
Pemi does not sell your personal information in the traditional sense. We do not exchange your data for money. However, like many e-commerce businesses, we use advertising technologies (such as the Meta Pixel and Google Analytics) that may constitute "sharing" under California law for the purpose of cross-context behavioral advertising.
Your Privacy Rights
If you are a resident of California, Virginia, Colorado, Connecticut, Utah, or another state with applicable privacy laws, you have the following rights:
- Right to know. Request information about the personal data we collect, use, and share.
- Right to access. Request a copy of the personal data we hold about you.
- Right to delete. Request that we delete personal data we have collected from you, with some legal exceptions.
- Right to correct. Request that we correct inaccurate personal data.
- Right to opt out. Direct us to stop selling or sharing your personal information for advertising purposes.
- Right to limit. Limit our use of sensitive personal information.
- Right to non-discrimination. We will not discriminate against you for exercising any of these rights. You will receive the same products, services, and pricing as customers who do not exercise their rights.
How to Opt Out of Sale or Sharing
You have several ways to opt out of the sharing of your personal information for advertising purposes:
1. Global Privacy Control (GPC) We honor the Global Privacy Control signal sent by certain browsers and browser extensions. If your browser sends a GPC signal, we will automatically treat it as a valid opt-out request for that browser and device. Learn more at globalprivacycontrol.org.
2. Cookie Preferences You can manage cookie preferences and opt out of advertising and analytics cookies through the cookie banner on our website or by updating your browser settings to block third-party cookies.
3. Submit a Request Directly Email us at contact@pemiwellness.com with the subject line "Do Not Sell or Share My Information" and include:
- Your full name
- The email address associated with your Pemi account or orders
- Your state of residence
- A description of the request (e.g., "Please opt me out of sharing my data for advertising purposes")
How to Submit Other Privacy Requests
For requests to access, delete, correct, or limit the use of your personal information, email us at contact@pemiwellness.com with the subject line corresponding to your request (e.g., "Right to Access Request," "Right to Delete Request").
Verification
To protect your information, we will verify your identity before responding to most privacy requests. We may ask you to confirm:
- Your full name and email address associated with your Pemi account
- Order information such as approximate order date or order number
- Any additional information reasonably necessary to confirm your identity
We will not respond to requests we cannot verify. If we cannot verify your identity, we will inform you and explain why.
Authorized Agents
You may designate an authorized agent to submit privacy requests on your behalf. We will require written proof of the agent's authorization and may also require you to verify your identity directly. To submit a request through an authorized agent, email us at contact@pemiwellness.com with appropriate documentation.
Response Time
We will respond to verified privacy requests within 45 days of receipt. If we need additional time, we will notify you in writing and explain the reason. The total response time will not exceed 90 days.
Categories of Personal Information We Collect
Within the past 12 months, Pemi may have collected the following categories of personal information:
- Identifiers: name, email address, mailing address, phone number, IP address, account login credentials
- Commercial information: purchase history, products viewed, subscription preferences
- Internet or network activity: browsing history on our website, interaction with our emails, device and browser information
- Geolocation data: general location based on IP address
- Inferences: preferences and characteristics derived from the above to deliver relevant content and product recommendations
- Sensitive personal information (with consent): information you voluntarily share through our quiz, including symptom responses (used to recommend products; not shared with third parties beyond service providers necessary to deliver our service)
We do not knowingly collect personal information from individuals under the age of 18.
Categories We "Share" for Advertising Purposes
We may share certain identifiers, internet activity, and inferences with the following categories of third parties for cross-context behavioral advertising:
- Advertising platforms (Meta, Google, TikTok, Pinterest)
- Analytics providers (Google Analytics)
- Email and SMS marketing platforms (when consented to)
We do not share sensitive personal information from our quiz with advertising partners.
Children's Privacy
Pemi products and services are intended for adults aged 18 and older. We do not knowingly collect personal information from children under 18. If we learn we have collected personal information from a child under 18, we will delete it.
